Terms & Conditions

TERMS & CONDITIONS: All guests must sign the Tour Agreement which contain the following:

The following Terms and Conditions form the basis of my contract with STORY Land & Sea® and I should therefore read them carefully.  In this document, I, and any minors in my charge, am referred to as “I,” “my” and/or “guest(s),” and any reference to STORY, SAVVY, SAVVY Adventures, STORY Land & Sea® (or its subsidiaries) means and/or refers to ‘QueensLander International LLC doing business as STORY Land & Sea®.’​

STORY Land & Sea® and its subsidiaries are trade names of Queenslander International LLC, a U.S. business registered in the State of Colorado. The home office is at 8100 S. Quebec St., B-206, Centennial, Colorado 80112, USA.​

​Reference to SUPPLIERS and SERVICE PROVIDERS means all third parties who provide services to me during my travel with STORY including airlines unless otherwise specified.​

​The following Terms and Conditions apply to all bookings with or through STORY Land & Sea®.  These terms and conditions supersede any others expressed in any other STORY Land & Sea® commentary whether written or spoken.  ​

​Proposals from STORY are valid for 48 hours, but are based on availability.  Prices and availability are subject to change until a trip is booked. Some items are non-refundable once a trip has been booked — the proposal/invoice and these Terms & Conditions together comprise my Tour Agreement.  We highly recommend some form of Trip Cancellation & Interruption protection which will be discussed below.​

​​WHO IS TRAVELING?
All guests must be over the age of 11, and all guests under 18 must be accompanied by an adult.  Group size is limited to 16 on our branded tours; although, accommodations can be made for a private group of over 16 on a personalized journey.  All guests must be able to keep up with the group per the Tour Captain. ​

​PARTICIPANT AGE REQUIREMENTS:​
​An adult must accompany travelers under the age of 18 years.  No children under the age of 11 are allowed on our branded small group tours; however, we can offer personalized or independent travel options for families with children under 11. ​

​VALID PASSPORTS:​
All guests of any age must have a valid passport prior to booking, and the passport needs to be valid for at least six (6) months past the return date of my itinerary. ​

​DECLARATION OF MOBILITY AND HEALTH:​
I agree to provide STORY with any mobility or health issues related to me personally or to a minor who is traveling with me that may impede my/our ability to successfully participate in the tour. I understand that I may be removed from any activities or from the STORY tour entirely (without compensation) should my mobility or health adversely affect the group tour as determined by my STORY Tour Captain.  If I (or my minor child) cannot walk and keep up with the group, I will be responsible for getting myself (and my minor child) to and from tour activities at my own expense. 

TRAVELER’S REPRESENTATIONS:​
I, as the traveler/guest, represent that neither I or anyone traveling with me as a minor has any physical or other condition or disability that could create a hazard to me or the minor. STORY Land & Sea® reserves the right to decline to accept anyone on a trip. STORY Land & Sea® reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip. Airlines used are not to be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. International air carriers are subject to international air conventions limiting their liability. The limitations of liability are contained on the reverse side of the airline ticket and form part of the terms and conditions of this package. The passage contract in use by these companies, when issued, shall constitute the sole contract between the companies and the purchaser of these travel programs and/or passage.

​TRAVEL INSURANCE:
STORY Land & Sea® recommends:  I understand that STORY recommends that I purchase travel cancellation and interruption protection within 14 days of my initial deposit to help protect me and my travel arrangements against the unexpected.  Protection plans can include coverage for Trip Cancellation, Trip Interruption, Emergency Medical and Emergency Evacuation/Repatriation, Trip Delay, Baggage Delay and more. ​

​As this product is not purchased through STORY Land & Sea®, I am responsible for making myself aware of the benefits and limitations of any policy that I purchase.  ​

​Many STORY guests have previously used Travelex Insurance, and the guests have found them to be reputable and easy to contact.   For more information on available plans or to enroll, go to travelexinsurance.com or contact Travelex Insurance Services at 800-228-9297.​

​If Travel Protection is Declined: I understand by not choosing travel protection that once I am within 180 days of a tour departure, there is no refund for any reason from STORY Land & Sea®.   ​


BOOKING: ​
I agree to comply by the following procedure:

1. Review and accept the Proposal document by clicking “Accept” on my proposal. I may alternately email my acceptance of the proposal.  

2.Review, initial and sign Terms and Conditions document. All guests 18 years of age and older must complete a separate Tour Agreement form. This Tour Agreement is the contract that goes into effect when the Confirmation Invoice is issued by, or on behalf of, STORY Land & Sea®.  ​

3. Make my deposit/payment online via my STORY Invoice OR call STORY at 1 877 865 6711 to provide my credit card details over the phone. Payments may also be accepted by hard copy check or bank wire transfer. 

4. Receive a confirmation email from STORY. 

DELAYED CONFIRMATION:
Occasionally, STORY Land & Sea® is unable to confirm certain arrangements immediately (e.g. where preferred accommodation or service is available at the time of the guest proposal, but after payment is received the accommodation or service is no longer available). Details on booked services and hotels will be provided in my final trip documents. If any service, excursion or property that has been specifically ordered cannot be obtained, STORY will notify me prior to departure with a similar alternative(s). Certain services are non-refundable and these will be disclosed to me in my proposal or shortly after the time it’s requested. ​Reservations Requiring Passport for Pricing: As stated above, some tours require On-Tour Flights and pricing for these flights cannot be locked in until a passport is received.  ​Prices may change until ticketed by STORY and any price differences due to the delay of receiving a Passport are the responsibility of the guest(s).


MY RESPONSIBILITIES:
I am responsible for checking all details of the Confirmation invoice and all other documentation (including airline tickets, if applicable) immediately upon receipt. I will inform STORY immediately if anything appears to be incorrect as it may not be possible to make changes at a later stage.  STORY regrets that it cannot accept any liability if STORY is not notified by me of any inaccuracies in any documentation within TWENTY-FOUR (24) hours of the issuance from STORY.

EXCLUSIONS FROM TOUR PRICE PROPOSAL:
The STORY Tour prices provided in the proposals are for land only and do not include international flights to and from the beginning and ending locations (tour commencement and conclusion locations). Some tours require On-Tour Flights, and these flights are priced separately from land tours on most departures (unless otherwise noted) and they are non-refundable.

PROVIDING VALID PASSPORT(s): ​
Passport Biodata Page: A copy of my, and any minors in my charge, valid Passport(s) showing the biodata page (the page with my biographical data including name, date of birth, passport number, expiration date, and photo) is required within SEVEN (7) days of STORY receiving my booking and acceptance of Terms & Conditions agreement. ​No services will be arranged for my booking until STORY is in receipt of my valid passport. 

PAYMENTS, CHANGES and REFUNDS: ​

PAYMENTS & BALANCE DUE (for bookings made prior to March 12, 2020:)​
​Tours commencing within 90 days of initial booking: Payment is due in full and is non-refundable.  Tours commencing greater than 90 days of initial booking: A deposit of $700 per person is required (unless otherwise noted) at the time of booking.  Remaining balance is due 90 days prior to my trip departure date. Any payment made is fully refundable up until 90 days before the tour (unless otherwise noted).  Payment is not refundable within 90 days of departure. Some excursions, on-tour flights, trains and other items are non-refundable regardless of booking date and will be noted on my invoice. 

PAYMENTS & BALANCE DUE (for bookings made on March 12, 2020 or later:) ​
Tours commencing within 180 days of initial booking: Payment is due in full and is non- refundable.  Tours commencing greater than 180 days of initial booking: A deposit of $700 per person is required (unless otherwise noted) and is 100% refundable for the first 30 days from initial deposit.  Remaining balance is due 180 days prior to my trip departure date. Any payment made (less the first $700 per person deposit is fully refundable up until 180 days before the tour (unless otherwise noted).  Some excursions, on-tour flights, trains and other items are non-refundable regardless of booking date and will be noted on my invoice. ​

 

CHANGES/AMENDMENTS BY GUESTS:​
Should I wish to make any changes to my booking after it has been confirmed (e.g., changes to departure or return dates, destination, hotels, etc.), I must advise STORY in writing by email or hardcopy, and I must confirm STORY is in receipt of this notification.  Change requests to my reservation within 60 days of my departure date will result in a $50 change fee per person, per request. While we will endeavor to assist, we cannot guarantee we will be able to meet such requests.  ​

PERSONALIZED JOURNEYS:
On Personalized Journeys a non-refundable deposit is required to receive a detailed proposal. Guests must obey the laws of the land and STORY has no liability as a result of inappropriate or illegal guest behavior and its consequences.  

STORY ARRANGED AIR SERVICE: ​
Separate booking: Any air arrangement made by STORY’s air service is a completely separate booking from guest(s) STORY land vacation. ​Any questions concerning booked guest airfare should be directed to the booking agency (online agencies, travel agencies, STORY Air, etc.). When changes can be made: If flight changes are requested after the deposit has been received, or if flights are cancelled by the guest(s) after tickets are issued, revision fees or airline cancellation charges will apply. ​When changes cannot be made:  For certain air arrangements, changes cannot be made after reservations have been ticketed as disclosed via the guest(s) separate air invoice.  Should I wish to make any amendments to those bookings I will incur a 100% cancellation charge and any new arrangements will be treated as a re-booking.  ​

TOURS PREVENTED FROM OPERATING:​
I understand that STORY Land & Sea® may be prevented from operating a tour under one of two scenarios:​​

Minimum Number of Guests: Some tours may fall under our Book with Confidence​ program which states that if a tour does not have the minimum number of guests required to operate at 120 days prior to the departure, STORY Land & Sea® may choose to cancel the tour. Under this scenario guests will be given the option to continue with the itinerary on a modified basis using a STORY Local Host and with all services as purchased including transfers, luggage movement, admissions and itinerary the same as per our website. Additional costs may arise and will be provided to booked guests for review and approval. Alternatively, at the 120 day mark, or according to the cancellation policy, guests may choose to cancel their tour and receive a full refund. (Note, only tours with the Book with Confidence program included can provide the refund at 120 days prior to the tour. All other tours follow the cancellation policy as stated above.) 

Circumstances beyond the control of STORY Land & Sea®: ​The second scenario in which STORY may be prevented from operating a tour is due to Force Majeure.​

FORCE MAJEURE: STORY regrets it cannot accept any liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented by reasons or circumstances amounting to ‘force majeure.’ Force majeure means any event which STORY Land & Sea® or the supplier of the service(s) in question could not, even with all due diligence, foresee or avoid. STORY assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other Force Majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms, cyclones or hurricanes, civil unrest, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests or police action, strikes or labor disruptions, restrictions or restraint of rulers, peoples or governments, governmental or other expropriations, acts of terrorism, war insurrections, quarantine restrictions, epidemics, pandemics, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by STORY Land & Sea® that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, STORY Land & Sea® shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.

​REFUNDS ON LAND VACATIONS:​
Refunds may take up to 120 days to process. STORY Land & Sea® cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through STORY.​

SCHEDULE CHANGES:​
If STORY is notified, prior to guest(s) departure, STORY Land & Sea® will advise guest(s) of any relevant schedule changes to the itinerary. While STORY Land & Sea® will endeavor to assist guest(s) with any such changes, STORY Land & Sea® is not liable for any additional expenses guests may incur through a change in itinerary.​

​DELAYS:​
STORY Land & Sea® regrets it is not in a position to render any assistance in the event I am  delayed at my outward or homeward points of departure. I AM RESPONSIBLE FOR ARRIVING ON TIME TO POINTS OF ORIGINATION BY STORY Land & Sea OR STORY Land & Sea AGENTS.

​​GRATUITIES:​
STORY Land & Sea® provides on our branded STORY Tours (not Personalized Journeys) gratuities for the Local City Tour Guides, Tour Drivers, Restaurant and Hotel Staff. Customary gratuities from $20 per person per day for the Tour Captain are not included in my tour package and should be extended on a voluntary, discretionary basis. ​

SPECIAL REQUESTS:​
If I have any special requests, I will inform STORY Land & Sea® as soon as possible in writing. Although STORY will endeavor to meet my requests, and I understand that STORY cannot guarantee to do so. STORY’s failure to accommodate my special requests will not be a breach of contract on the part of STORY.  STORY Land & Sea® cannot accept bookings that are conditional on the fulfillment of any special request; and such booking will be treated as a ‘normal’ booking (with no special requests.)​

​LIMITS ON STORY RESPONSIBILITY:​
I understand that STORY Land & Sea®, its employees, officers, directors, guides, Tour Captains, staff and agents, do not own or operate any entity which is intended to or does provide goods or services for my travel event. It purchases transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, STORY Land & Sea® is not liable for any negligent or willful act of any such person or entity or of any third person. In addition and without limitation, STORY Land & Sea® is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or Force Majeure, illness, disease, food poisoning, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, quarantines, criminal or terrorist activities of any kind, over booking or downgrading of services, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. There are certain inherent risks in travel of the type involved with STORY Land & Sea®. These include, but are not limited to, risks of river cruising, hiking, walking travel events, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency.  I understand that I assume all such risks with regard to these possibilities.

ARBITRATION AGREEMENT: ​
Any controversy or claim arising out of or relating to these Terms and Conditions, to the Limits on STORY Land & Sea’s responsibility clause, to the brochure, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in Denver, Colorado, in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.​

​I understand that arbitration against STORY Land & Sea® must be commenced within one year following the date of travel event completion. Neither STORY Land & Sea® nor any affiliate shall in any case be liable for other than compensatory damages, and I hereby waive any right to punitive damages.

PARTICIPATION & ​CONDUCT WHILE ON TOUR:​
STORY Land & Sea® offers small group travel events. I understand that when I participate in a group travel event, STORY Land & Sea® will do its best to ensure that my trip is enjoyable for the entire group. I am responsible for respecting the authority and following the directions of the Tour Captain, any guidelines expressed or implied from STORY Land & Sea® tour communications, and the laws of the countries in the Itinerary during a Tour.  STORY Land & Sea® may exclude me from participating in all or any part of the tour or remove me entirely from the Tour if, at the sole discretion of STORY Tour Captain, my condition or behavior renders me unfit for the Tour or unfit for continuation once the Tour has begun. Unfitness may include, without limitation, any behavior that regardless of its cause, is inappropriate or offensive or interferes with the delivery of Tour services or may constitute a hazard or embarrassment. Any decision(s)s to exclude or remove me or members of my party are at the complete discretion of the STORY Tour Captain. 

Should I decide for any reason not to participate in certain parts of the Tour or use certain goods included in the Tour, no refunds will be made for those unused parts or goods of the Tour.

In either case, STORY Land & Sea® will not refund or cover any cost or expenses incurred for termination of vacation arrangements due to unacceptable conduct and will offer no assistance with onward travel.

SPECIAL ASSISTANCE:​
I understand that I and any minors in my charge are required to provide a description of any disabilities or needs that would require special assistance. It is my responsibility to report those needs to STORY Land & Sea® at the time the reservation is made. STORY Land & Sea® will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so, nor is STORY Land & Sea® responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. STORY Land & Sea® cannot provide assistance to a traveler for walking, dining, getting on and off transportation, or other personal needs. STORY Land & Sea® requires that a qualified and physically able companion must accompany travelers who need such assistance. STORY Land & Sea® is not responsible for any missed activities due to a participant’s inability to participate with the group. 

​SIGNATURE INDICATING AGREEMENT BY GUEST:​
By signing the Tour Agreement, I am indicating that I have read, understood and agreed to all Terms and Conditions outlined in the contract (Tour Agreement).​
